FORECLOSURE SALES, MUNI-TECHNOLOGY BILLS EMERGE FOR SENATE ACTION

STATE HOUSE, BOSTON, JULY 28, 2015....The state Senate is moving quickly on legislation aimed at fostering stronger connections between the state's 351 cities and towns and technology startups with products that might make local government more responsive and efficient.
The Senate on Tuesday also teed up a bill (S 1981) for consideration this week aimed at clearing titles to foreclosed properties. The bill stipulates that affidavits required to be filed after a foreclosure sale would constitute "conclusive evidence" in favor of an arm's length third party purchaser "that the power of sale under a foreclosed mortgage was duly executed." The bill also includes language defining when an affidavit would not be considered conclusive evidence.
